Boshears Wants Charges for Second Trial Dismissed

Attorneys for 38 year old accused killer Jeremy Boshears of Coal City, have filed a motion in Will County Court to dismiss the case on double jeopardy grounds.  Boshears was granted a new trial in January because of what the judge said were the cumulative effect of errors committed by the prosecution during Boshears first trial in 2022 which ended in a murder conviction.  In the motion, Boshears attorneys say their client should be released because prosecutors tried to subvert protections afforded by the double jeopardy clause of the constitution.  The clause prevents a suspect from being tried twice on the same charges.  There’s another hearing scheduled for tomorrow.  Boshears is accused of shooting and killing 34 year old Katie Kearns at the Joliet Outlaws Clubhouse then of disposing of her body in a Kankakee County barn.
